1. Who we are

These terms are an agreement between [Company legal name] (“Trialhood”, “we”) and the business that uses the service (“you”). By sending us your store link, creating an account or installing the app, you accept them on behalf of that business.

2. The service

Trialhood provides a 3D viewer and AR placement for product pages, virtual try-on for eyewear product pages, tools to prepare 3D models of your products from photos, and a dashboard to review, publish and measure them. Try-on is a visual style preview. It is not a prescription, fitting or measurement service, and shoppers must not rely on it for medical or sizing decisions.

3. Pilot, plans and payment

The Founding Partner pilot is free: we prepare the first 3 products at no charge and nothing is billed without your written agreement. Paid plans are billed monthly in US dollars at the prices published on our pricing page at the time you subscribe. Shopify stores are billed through Shopify Billing; other stores by invoice or card. Prices exclude taxes, which are added where they apply. Plans have published allowances; at your limit shoppers see your regular product images, and we never charge overage without your agreement. Price changes are announced at least 30 days before they apply to you, and the founding price lock stays in force for its full term.

4. Your content and 3D models

You keep ownership of your product photos and of the 3D models we prepare for you once they are paid for or included in your plan. You can download approved models at any time. You grant us a non-exclusive, worldwide licence to host, process, convert and display your photos and models only as needed to provide the service to you and your shoppers, including on your storefront and in your dashboard. The licence ends when your account ends, except for backups that we delete in the ordinary course within 90 days. You confirm that you have the rights to the photos and products you submit.

5. Your responsibilities for shopper consent

You are responsible for the notice, retention statement and consent settings shown to your shoppers, and for reviewing them with your own counsel for the places you sell to. We provide templates and regional switches as a starting point only, and we never process face data on our servers.

6. Acceptable use

You must not: upload product images, photos or other content you do not have the rights to; use the service for anything unlawful or misleading; disable, bypass or alter the consent screen shown to shoppers; attempt to access other merchants' data; reverse engineer the storefront script beyond what the law allows; place abusive or automated load on the service; or resell the service as your own without our written agreement. We may suspend an account that breaks these rules after telling you, or immediately where shoppers' privacy is at risk.

7. Availability and support

During the pilot, support is a direct line to the founder by email, without a published response target or uptime commitment. If the service is unavailable, your product pages fall back to your regular images; the storefront script never blocks your store. Service levels for paid plans are published with the final version of these terms.

8. Liability

The service is provided as it is during the pilot. We are not liable for indirect or consequential losses, including lost sales or profits. For paid plans, our total liability for any claim in a 12-month period is limited to the fees you paid us in that period. Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

9. Termination

You can cancel at any time from the dashboard or by email; billing stops at the end of the current period. We can end the agreement with 30 days' notice, or sooner for a serious breach of section 6. After the account ends, your approved 3D models remain downloadable for 90 days, after which we delete them together with your photos.

10. Changes to these terms

We tell you by email at least 30 days before a change that affects you, and keep earlier versions available on request. Continuing to use the service after that date means you accept the change.

11. Governing law

These terms are governed by the law of [Jurisdiction], and its courts have exclusive jurisdiction, without affecting any consumer or mandatory protections where you are based.
